Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Manadamus, directing the respondents to provide the rent for the petitioner's property in Survey No.234/3A, Door No.211, Madurai Main Road, Usilampatti, Madurai District, as admitted by the second respondent in his communication sent to the first respondent in Na.Ka.No.1718/2021-A4, dated 17.08.2021 by opening the TASMAC Elite Shop No.5581. ORDER

The petitioner has filed this petition seeking for a mandamus to direct the respondents to take the petitioner's property on rent. 2.It is the case of the petitioner that earlier, the Sub Registrar has arrived at a monthly rent of property at Rs.400/- per 1/3

sq.ft. It was later reduced to Rs.40/- per sq.ft and further reduced to Rs.35/- per sq.ft.

3.The learned counsel for the petitioner submits that the petitioner is also amenable to give the property on rent to the respondents/TASMAC on the reduced value arrived at Rs.35/- per sq.ft.

4.The learned Standing Counsel for the respondents submits that the first respondent is under active consideration of the representation and appropriate orders will be passed as to whether the property in question is to be finally taken on rent or not. 5.Recording the above submission of the learned Standing Counsel for the respondents, I dispose of the writ petition by directing the respondents to take an appropriate decision within a period of ten days from the date of receipt of a copy of this order. In case, the property needs all the requirements for running the rental shop, the respondents shall pass appropriate orders on merits and in accordance with law.
