JUDGMENT

This appeal has been filed against the judgment and decree passed in A.S.No.26 of 2005 dated 30.10.2006 on the file of the I-Additional District Judge, Madurai, confirming the judgment and decree in O.S.No.875 of 1997 dated 08.04.2003 on the file of the II-Additional Sub-Judge, Madurai.

2. When the matter is taken up for hearing, the learned counsel appearing for the appellant submitted that during pendency of this appeal, the matter has been settled out of Court and hence, nothing survives for further adjudication in this appeal.

3. Recording the aforesaid submissions, the Second Appeal is dismissed as infructuous. No costs.
