: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records of the first respondent in his proceedings in Na.Ka.No.490/A/AKaE/2008, dated 17.01.2009 and quash the same and consequently, direct the first respondent to give the posting of Superviser-in-charge of Block Resource Teacher Educators in Kamudhi Block.

O R D E R

*********** One P.Balasubramanian, Superviser, Block Resource Center, Paramakudi, was entrusted with additional charge of Block Resource Teacher. Since P.Balasubramanian's performance was not satisfactory, as his health condition was not good, the Chief Educational Officer (In-charge), Ramanathapuram, by the impugned order dated 17.01.2009, assigned the additional responsibilities to Mangalanathan. Challenging that, the petitioner has preferred the present Writ Petition.

W.P.[MD].No.2292 of 2009 that the order passed by the Chief Educational Officer deserves to be set aside, as he had ignored the rightful claims of the petitioner.

3. Per contra, the learned Special Government Pleader for Education submitted that there were several allegations against the petitioner and, therefore, the additional responsibility was given to Mangalanathan.

4. In the opinion of this Court, when a person does not have a vested right to seek additional responsibilities and when the Chief Educational Officer had chosen to give such responsibilities to Mangalanathan, the same cannot be questioned in Writ Proceedings. Hence, the Writ Petition is devoid of merit and accordingly, the same is dismissed. No costs.
