JUDGMENT

Today, when the matter is taken up for hearing, the Learned Counsel appearing for the appellant submitted that there is no instructions from the appellant. To this effect, he has filed a memo seeking permission to withdraw his vakalat.

2. Accepting the aforesaid memo, this Second Appeal is dismissed for non prosecution. Liberty is granted, in case if the appellant wants to adjudicate the case he can reopen and contest the same. No Costs.
