PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus, calling for the records of the first respondent in his proceedings B2-1276-09 dated 23.03.2009 and quash the same and consequently direct the first respondent to conduct fresh auction.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM,J.) When the matter came up for hearing on 05.10.2023, there was no representation on behalf the petitioner and hence, the matter was directed to be posted under the caption "for dismissal". Accordingly, it is listed today, i.e., 09.10.2023. Even today, when the matter was taken up for hearing, there was no representation for the petitioner. In such circumstances, this Court has no other option except to dismiss the writ petition for non- prosecution.

2. Accordingly, the writ petition is dismissed for non-prosecution. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
