JUDGMENT

This Second Appeal is filed against the judgment and decree dated 29.03.2011 made in A.S.No.61 of 2010 on the file of the Sub Court, Paramakudi confirming the judgment and decree dated 21.06.2009 made in O.S. No.174 of 2004 on the file of the District Munsif Court, Mudukulathur.

2. Today, when the matter is taken up for hearing, the learned counsel for the appellant filed a memo stating that the appellant is no more and the legal heirs of the deceased/appellant is not interested in prosecuting the case.

3. In view of the same, the Second Appeal is dismissed as abated. No costs.
