JUDGMENT

This second appeal has been filed to set aside the judgment and decree dated 01.02.2011 made in A.S.No.2 of 2011 on the file of the Sub Court, Devakottai confirming the judgment and decree dated 20.07.2009 made in O.S.No.187 of 2005 on the file of the Additional District Munsif Court, Karaikudi.

2.Today, when the matter is taken up for hearing, the learned counsel appearing for the appellant, on instructions, would submit that the matter has been settled out of the Court. He has also made an endorsement to that effect.

3.Recording the above submission and endorsement, this second appeal is dismissed as settled out of the Court. No costs. Consequently, connected miscellaneous petition is closed.
