ORDER : The Court Made the following order :- The petitioner / A7, who was arrested on 10.11.2017 for the offence punishable under Sections 457(2), 380(2) and 202 IPC in Crime No.04 of 2017, seeks bail.

2.The case of the prosecution is that when the petitioner was in service, he undertook the safe custody of temple idols. After his retirement, he did not hand over the said idols to his successor.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody from 10.11.2017 onwards. 4.The learned Government Advocate (Crl.side) submitted that the stolen properties were not recovered. According to him, investigation is still pending.

5.The submissions made by the learned counsel appearing on either side are considered. It is alleged that during the time of occurrence, the idols worth about Rs.100 crores were stolen away. The petitioner herein was working as Executing Officer, at the time of alleged occurrence. The said occurrence came to light only at the time when this petitioner handing over the charge to the https://hcservices.ecourts.gov.in/hcservices/

successor. As per the case of the prosecution, as of now, the stolen properties were not yet recovered. Further, some of the accused in this case are not yet arrested. So, considering all those aspects, custodial interrogation is necessary for completing the investigation.

6.Considering the above facts and circumstances of the case, this Court is inclined to grant bail to the petitioner at this stage.
