ORDER

The petitioner has participated in the tender invited by the TASMAC for running a Bar attached with the Tasmac shop No.8613, where, he was declared as the highest bidder. Instead, the 2nd respondent, by the impugned order dated 22.12.2023, selected the second successful bidder, namely, the 3rd respondent herein. Challenging the same, the petitioner has filed this writ petition.

2. The learned Standing Counsel appearing for the respondents 1 and 2 submits that in the tender notification, it has been specifically stated that the persons, who are intending to participate in the tender, should obtain No Objection Certificate from the land owners. Since the petitioner was not having No Objection Certificate from the land 2/4

owner, his bid was not considered by the 2nd respondent.

3. This Court has provided an opportunity to the petitioner to get No Objection Certificate from the land owner. However, the petitioner has expressed his difficulty in getting No Objection Certificate from the land owner.

4. Since the petitioner has not complied with the condition as stipulated in the tender notification, this Court is not inclined to entertain this writ petition. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 11.01.2024 ogy NCC : Yes / No.
