To allow this appeal and set-aside the Judgment and Decree dated 13.07.2017 passed in M.C.O.P.No.255 of 2015 on the file of the Motor Accident Claims Tribunal, Sub-Court, Kulithalai. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.S.MATHIALAGAN, Advocate for the petitioner, the court made the following order:- Being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, the delay of 396 days in filing the appeal is condoned with cost of Rs.500/- to the credit of Chief Justice Relief fund, within a period of two weeks from the date receipt of a copy of this order and also deposit 50% of the award amount to the credit of M.C.O.P.No.255 of 2014, on the file of the Motor Accident Claims Tribunal, Sub Court, Kulithalai, within a period two weeks from the date of receipt of a copy of this order, failing which, this Civil Miscellaneous Appeal will be automatically rejected.
