Prayer in CRP(MD). 2554/ 2018 :- Civil Revision Petition filed under section 25 of TamilNadu Building (Lease & Rent Control) Act,to set aside the order and decree dated 09.10.2017 in R.C.A.No.8 of 2012, on the file of Rent Control Appellate Authority cum Subordinate Judge, Ramanathapuram in reversing the order and decree dated 13.09.2012 in RCOP No.3 of 2010, on the file of Rent Controller cum District Munsif Court, Ramanathapuram.
ORDER:- This Civil Revision Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon the apperance of MR.V.RAGHAVACHARI, Advocate for the Petitioner and of MR.J.M.HASSANUEL BAZARI, Advocate for the respondent, this Court made the following order: This Civil Miscellaneous Petition has been filed to extend the time for a further period of three months ie., till 31.08.2019 to vacate the premises and hand over the vacant possession. 2.On 16.11.2018, when the matter was taken up for hearing, the petitioner was given sufficient time to vacate the premises, but now, the petitioner sought for further period of three months time to vacate the premises, whereas, the respondent contended that already the premises was vacated by the petitioner and he is also running a hospital in another place.

3.Since the premises is vacated, there cannot be any further time granted to vacate the premises. Hence, there is no merit in this Civil Miscellaneous Petition and the same is dismissed. If the petitioner/tenant shall not vacate the premises and hand over the key to the respondent immediately, the respondent/landlord is at liberty to execute the case.
