Respondents PRAYER:- Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, directing the respondents to grant permission to the petitioner to conduct Kabadi Tournament at Thai Pongal Festival Duraisamiyapuram, Sivagiri Taluk, Thenkasi District, on 15.01.2021 from 1.00 A.M. to 2.00 P.M and prize distributing function at 8.00 p.m. On 16.01.2021, on the basis of the petitioner's representation dated 29.12.2020 made to the 2nd Respondent.

ORDER

By consent, this writ petition is taken up for final disposal at the stage of admission itself.

Mr.M.Boominathan, learned counsel appearing for the petitioner would submit that the petitioner used to conduct Kabadi Tournament during Thai Pongal Festival for the past 51 years and that Kabadi Tournament is to be conducted on 15.01.2021 & 16.01.2021 at Thai Pongal Festival Duraisamiyapuram, Sivagiri Taluk, Thenkasi District. His further submission is that he has submitted a representation dated 29.12.2021 to the second respondent seeking permission to conduct the said events and so far, no action has been taken by the respondents. Hence, the petitioner is before this Court.

3. Mr.R.Saravana Kumar, learned Government Advocate (Crl. Side) who takes notice for the respondents, would contend that as per G.O.(Ms) No.654 (Revenue and Disaster Management (DM-IV) Department) dated 21.11.2020, the District Collector is the competent authority to consider the request of the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2

In the circumstances, without going into the merits of the claim made by the petitioner, this Court directs the petitioner to submit a representation to the concerned District Collector and on receipt of such representation the concerned District Collector is requested to consider the representation of the petitioner and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

5. With the above observations, this petition is disposed of. No costs.
