Respondents Prayer: This Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the respondents 1 to 3 to transfer the complaint given by the petitioner against one Mr.Eswaran S/o. Ramadoss dated 14.08.2021, on the file of the sixth respondent and entrust the same to the police officials in the fourth respondent in accordance with law within the time stipulated by this Court. O R D E R
This Criminal Original Petition has been filed seeking transfer of enquiry from the file of the sixth respondent. Since even FIR has not been registered, after going through the contentions of the petitioner's counsel, the interest of justice will be met, if the following directions are issued:- (i) The sixth respondent is directed to conclude the enquiry within a period of three weeks from the date of receipt of a copy of this order;
(ii) If at the end of the enquiry, the sixth respondent comes to the conclusion, cognizable offences are made out, FIR shall be registered and action shall be taken in accordance with law;
(iii)If the sixth respondent is of the view that no case is made out or there are some statutory impediments for registering a case, then the petitioner shall be informed accordingly in writing, so that the petitioner can take recourse to other legal remedies.
2.With this direction to the sixth respondent, the Criminal Original Petition is disposed of.
