ORDER

This Criminal Original Petition has been filed seeking a direction to the Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act Cases, Theni, to accept the surrender of the petitioner and consider his bail application on the same day on merits in relating to Crime No.622 of 2025 dated 30.12.2025 on the file of the second respondent police.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that the defacto complainant is working as Permanent Sanitary Supervisor and the pettioner is working 2/5

as Junior Assistant in Genguvarpatti Town Panchayat. On the date of occurrence, when the defacto complainant went to the office, he found that his table and chair had been thrown out. When the same was questioned by the defacto complainant, the petitioner abused him in filthy language by referring to his caste and intimidated him with dire consequences. Based on these allegations, an FIR has been registered against the petitioner.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act Cases, Theni, to issue prior notice to the de facto complainant and thereafter, to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.622 of 2025 on the file of the 2nd respondent police.
