Heard the learned counsel appearing for the revision petitioner. The respondents have been served and their names are printed, they have not chosen to enter appearance.

2.The learned counsel for the revision petitioner fairly states that the IA prayer ought to have been worded differently. 3.In this view of the matter, the petitioner is permitted to withdraw the IA itself. The petitioner is permitted to file a fresh IA by couching his prayer appropriately. As and when such an IA is filed, it shall be independently dealt with by the Court below without reference to the impugned order dated 09.11.2023 made in I.A.No.9 of 2022. 2/4

4.This Civil Revision Petition is disposed of accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
