PETITIONS FOR BAIL Under Sec.439 of Cr.P.C.
COMMON PRAYER :- For Bail in Crime No. 1062 of 2021 on the file of the respondent police.
COMMON ORDER : The Court made the following order :- The petitioners/Accused herein, who were arrested on 24.09.2021 and 25.09.2021 respectively for the alleged offence under Sections 302 @ 120(B), 302 and 212 of IPC, in Crime No.1062 of 2021on the file of the respondent police, seek bail.
2.The case of the prosecution is that the defacto complainant's husband was murdered by the accused persons and found the deceased severed head in nearby Bus Stop and body was found in nearby Primary Health Centre. Hence, the case. Thereafter, the accused persons were arrested.
3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). Nos.349 of 2022 and 20580 of 2021 prosecution. The petitioners were implicated only on the basis of the confessions statement of the other accused. 4.The learned Additional Public Prosecutor submitted that investigation has been completed and charge sheet has been filed in PRC No.78 of 2021 before the concerned Court. 5.Considering the overt act attributed against the petitioners and the period of incarceration, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Dindigul, and on further condition that the petitioners shall report before the respondent police once in fifteen days at 10.30 a.m. until further orders.
