For Respondent : Mr.RMS.Sethurman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1704 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC r/w 21(1) of Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.1704 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that the accused persons had illegally transported one unit of river sand without any valid permit in Force Tack Van. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he is no way connected with the offence. Hence, prays to release him on anticipatory bail. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that in this case, A1 & A3 were arrested and released on bail, this petitioner is A2 in this case and he is https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.263 of 2022 having three previous cases, all are similar in nature and that the investigation is not yet completed.
5.Considering the facts and circumstances of this case and that the petitioner is having three previous cases, which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
