O R D E R

The present writ petition has been filed seeking a Mandamus directing the respondents to admit the petitioner's son in the fourth respondent school to continue in 11th Standard and permit him to take part in the 11th Standard final Examination conducted by the respective school and thereby enrol his name in the list of students studied under the CBSE affiliated School.

According to the learned counsel appearing for the writ petitioner, the petitioner was studying in a private school where he got discontinued on 17.12.2025 and he seeks admission in the fourth respondent school in 11th Standard. The apprehension of the petitioner is that the fourth respondent school may not admit the petitioner's son in 11th Standard, in view of the fact that already the fourth respondent school has sent final list of students, who are appearing for the 12th Standard Board Examination. Hence, the present writ petition.

3. The learned Standing Counsel appearing for the first respondent submitted that he has received written instructions and the same is extracted 3/7

as follows:

"In this regard, it is informed that the Board has no direct role in the admission of students to Class XI in any school. Admission at end stage of the academic year is entirely within the discretion of the concerned school, including whether to admit a candidate. The role of Central Board of Secondary Education (CBSE) is limited to the registration of Class XI candidates based on the list submitted online by the School for the purpose of appearing in the Class XII Board Examinations and it does not exercise any authority over admissions. It is further submitted that the Class XI examination is conducted by the concerned school only where the candidate is studying."

The learned counsel appearing for the fourth respondent submitted that the school has already submitted the final list of students to the first respondent Board with regard to the students who are appearing for the +2 examination, however, they are ready to admit the writ petitioner. He seeks the direction of this Court to send the supplementary list of candidates who are appearing for the 12th Standard to the first respondent. 4/7

5. In view of the submissions made by the learned counsel on either side, this Court is inclined to pass the following order: a) The petitioner may be admitted to the fourth respondent School in 11th Standard as early as possible;

b) The fourth respondent School is directed to send the name of the writ petitioner for appearing in the +2 Examination to the first respondent by way of supplementary list;

c) In case, if any supplementary list is sent by the fourth respondent School, the same may be accepted by the first respondent and the petitioner may be permitted to appear for the +2 examination under the CBSE affiliated School category; and d) As far as the +1 examination is concerned, the fourth respondent may permit the petitioner to appear for the examination to be conducted by them. 5/7

6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
