This Writ Petition has been filed challenging the order passed by the second respondent, dated 23.06.2010 confirming the order passed by the first respondent, dated 26.11.2008. 2.When the matter is taken up for hearing, the learned Counsel for the petitioner, on instructions, would submit that the rights of the parties can be adjudicated in the pending second appeal before this Court in S.A.(MD)No.1242 of 2005. The said statement is recorded.

3.Accordingly, this Writ Petition is disposed of by directing the parties to get the relief in the pending second appeal before this Court in S.A.(MD)No.1242 of 2005. No costs.
