Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A2 apprehends arrest at the hands of the respondent police for the alleged offences punishable under sections 8(c) r/w 20(b)(ii)(B) and 25 of NDPS Act, in Crime No.258 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the accused were found in possession of 14 kgs of Ganja.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Criminal side) appearing for the respondent vehemently opposed this petition contending that the petitioner is having 9 previous cases of similar nature. 5.Considering the facts and circumstances of the case and also considering the bad antecedents against the petitioner, this court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
