PRAYER :- For Anticipatory Bail in Crime No.22 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 420 of IPC, in Crime No. 22 of 2024 on the file of the 1/3
respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioners are said to have misled the defacto complainant and her husband to invest in an IPO launching and thereby they had invested a sum of Rs.1,76,50,000/-. Out of this amount, a small portion was received as profits by the defacto complainant and her husband and the partnership firm had become a limited share company and one Muthusamy has been shown as the Promoter of the company.
3. Heard the learned counsel on either side and perused the material records of the case.
4. In the considered view of this Court, the entire case is borne out by records and no custodial interrogation may be required. Hence, there shall be a direction to the respondent police to resort to the procedure under Section 35 of BNSS and complete the investigation as expeditiously as possible.
