ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3 in Crime No.52 of 2015 on the file of the respondent police was arrested and remanded to judicial custody on 18.05.2015 for the alleged offences punishable under Sections 294(b), 323, 324 & 307 IPC and hence, seeks bail.
2.The case of the prosecution is that due to civil dispute the accused attacked the defacto complainant with lethal weapons and caused injury.
3.The learned counsel for the petitioner would submit that the petitioner is a senior citizen aged about 75 years and due to civil dispute he has been falsely implicated in this case. He would further submit that the injured has been discharged.
4. The learned Government Advocate (crl. side) appearing for the respondent police submitted that A1 is still absconding and the https://hcservices.ecourts.gov.in/hcservices/ accused No.2 was arrested and remanded to judicial custody and the injured has been discharged from the hospital.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Ottanchathiram, Dindigul District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., for a period of two weeks and thereafter as and when required. sd/- 18/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
