Common Prayer in CRP(MD).Nos.1567 and 2045 of 2015 : Civil Revision Petitions filed under Article 227 of the Constitution of India, against the fair and decreetal order dated 09.04.2015 made in I.A.Nos.8 and 9 of 2014 in H.M.O.P.No.169 OF 2012 on the file of the Family Court, Dindigul respectively. ORDER:- Civil Miscellaneous Petitions coming up for orders on this day and upon perusing the petitions and the affidavits filed in support thereof and upon hearing the arguments of Mr.T.Leninkumar, Advocate for the Petitioner and of Mr.S.C.Herold Singh, Advocate for the Respondent, this Court made the following order: These Civil Miscellaneous Petitions are filed for extension of time to comply with the order, dated 22.12.2020 passed by this court in CRP(MD)Nos.1567and 2045 of 2015 (NPD).
2.The learned counsel appearing for the petitioner submitted that challenging the order passed by the court below, the petitioner has filed CRP(MD)Nos.1567 and 2045 of 2015 and this court on 22.12.2020 heard both the revisions and allowed them on condition that the petitioner has to pay a sum of Rs.1,000/- as costs to the Legal Service Authority, attached to this Bench on or before 04.01.2021. But due to Christmas Holidays and the order was uploaded in the web-site only on 04.01.2021, he could not able to pay the cost within time and the above make is neither willful nor wanton and now, the petitioner has remitted a sum of Rs.1,000/- to the High https://hcservices.ecourts.gov.in/hcservices/ 1/2
CMP(MD). No.235 of 2021 Court Legal Aid committee, attached to this Bench, on 06.01.2021. 3.Heard the learned counsel appearing for the respondent and he has no objection for allowing these petitions. 4.It is seen from records that this court has passed an order on 22.12.2020, thereby allowed the civil revision filed by the petitioner in CRP(MD)Nos.1567 and 2045 of 2015 on condition that revision petitioner has to remit a sum of Rs.1,000/- as costs, to the High Court Legal Services Authority attached to this Bench, Madurai, on or before 04.01.2021.
5.It is the main contention of the learned counsel for the petitioner that due to Christmas holidays, the order, dated 22.12.2020, passed by this court, has not complied with by the petitioner. Now, the petitioner has filed the extension petition and he has also paid the costs to the High Court Legal Services Authority, on 06.01.2021.
6.Considering the fact that due to Christmas Holiday and the order copy was uploaded in the web-site only on 04.01.2021 and the petitioner has also paid the cost to the High Court Legal Services Authority, on 06.01.2021, these Civil Miscellaneous Petitions are allowed. As the petitioner has complied with the order passed by this court, by remitting the cost to the High Court Legal Services Authority, on 06.01.2021, this court is of the view that the order of this court, dated 22.12.2020 passed in CRP(MD)Nos.1567 and 2045 of 2015 (NPD) has been complied with.
