ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents 1 and 2 to conduct a survey and fix boundaries in the lands comprised in Survey Nos.1/1A, 1/1B, 1/2A1, 1/2A2, and 1/2A3, situated at A. Kovilpatti Village, Vadipatti Taluk, Madurai District, on the basis of the petitioner's application dated 30.06.2025, within a time frame to be fixed by this Court, and consequently, directing the third respondent to provide necessary police protection, if required, during the survey process.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner submits that the petitioner and his wife are the absolute owners of the property in question and that an application dated 30.06.2025 was made seeking survey and demarcation
of the boundaries of the said property. Since no action has been taken by the respondents 1 and 2, the present writ petition has been filed.
4. The learned Government Advocate appearing for the respondents 1 and 2 submits that after issuing notice to the adjacent land owners, appropriate steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.
5. Recording the aforesaid submission, this writ petition stands disposed of with a direction to the respondents 1 and 2 to consider and dispose of the petitioner's application dated 30.06.2025 for survey and demarcation on merits and in accordance with law. Notice shall be issued to the petitioner and the owners of adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act 1923, within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
