ORDER : The Court made the following order :- The petitioner / Sole Accused, who was arrested and remanded to judicial 1/4
custody on 12.03.2024 for the alleged offence under Sections 6 r/w. Sections 5(1), 5(n), 7 and 8 of the Protection of Children from Sexual Offences Act, 2012 and 506(1) of IPC, in Crime No.96 of 2024, on the file of the respondent police, seeks bail.
2. Heard the learned counsel on either side and perused the material records of the case.
3. This is the second bail application filed by the petitioner. The first bail application filed in Crl.OP(MD).No.16267 of 2024 was dismissed as withdrawn by an order dated 26.09.2024.
4. This Court had the opportunity to go through the statements recorded from the victim girls under Section 164 of CrPC. The victim girls are none other than the daughters of the petitioner.
5. The learned Additional Public Prosecutor submitted that the investigation has been completed and the police report was filed before the learned Sessions Judge, Special Court for POCSO Act Cases, Tirunelveli and the same was taken on file in Spl.S.C.No.612 of 2024. The learned Additional Public Prosecutor further submitted that the matter is posted today for furnishing copies. 2/4
6. Taking into consideration the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail at this stage. The important witnesses namely the victim girls must be examined before the Court and thereafter, the petitioner can file a fresh bail application seeking for enlargement on bail.
7. In view of the above, this criminal original petition is dismissed for the present.
