ORDER

Mr.D.S.Neduncheliyan, learned Government Advocate takes notice for the first respondent and Mr.N.Dilipkumar, learned Standing Counsel takes notice for the second respondent. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The prayer in the Writ Petition reads as follows:- "To issue a Writ of Certiorarified Mandamus, to call for the impugned tender cum auction notification on the file of second respondent vide Na.Ka.No.A2/360/2024 dated 05.12.2024 in concerned with the subsequent oral auction proceedings alone and quash the same as illegal and devoid of merits and to direct the second respondent to evaluate the documents submitted in online in the E-Tender proceedings."

3. Heard the learned counsels on either sides and carefully perused the 2/4

materials available on record.

When the matter came up for hearing, the learned standing Counsel appearing for the second respondent on written instruction would submit that due to certain indifferences, which culminated in a clash between the proposed tenderer resulting in registration of First Information Report. The said tender is cancelled and it is further proposed to call for tender through online and such proposal has already been sent to the Assistant Director of Town Panchayat on 03.01.2025.

5. Recording the same, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 06.01.2025 NCC : Yes / No Index : Yes / No jbr 3/4
