Aa5/6341/2023 dated 21.09.2023 issued by the 2nd Respondent and quash the same as illegal and consequently direct the 1st respondent to revoke the settlement deed vide Doc No. 1974/2013 dated 06.06.2013 executed by petitioner in favour of his elder son Ganesan at Idalakudi Sub register office. 1/4

ORDER

This writ petition is filed challenging the order of the second respondent/Revenue Divisional Officer in Mu.Mu. Aa5/6341/2023 dated 21.09.2023.

2. When the matter is taken up for hearing today, the learned Special Government appearing appearing for the respondents 1 and 2 would submit that as against the impugned order, the petitioner has already filed an appeal before the first respondent and the same was dismissed by the first respondent vide order dated 08.01.2024. He has also produced a copy of the order passed by the first respondent in K.K.rp3/1422814/2023 dated 08.01.2024.

3. At this juncture, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this writ petition with a liberty to challenge the order of the first respondent dated 08.01.2024. 2/4

4. Recording the said submission, this writ petition is dismissed as withdrawn. The petitioner is at liberty to challenge the order of the first respondent in K.K.rp3/1422814/2023 dated 08.01.2024.
