Prayer in CRL OP(MD). 322/ 2022 :

To grant interim bail to the petitioner in the case of Special S.C.No.65 of 2018 on the file of the additional Sessions Judge (Special Court for Trial of cases under ST and SC Prevention of Atrocities Act ) Sivaganga for a period of 10 days from today. ORDER : The Court Made the following order :- The Accused No.14, who was arrested on 29.05.2018 for the offences punishable under Sections 302 r/w 147, 148, 294(b), 324, 307 IPC, Section 3 of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992 and Sections 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST Prevention of Atrocities Act, 1989, concerned in Special SC No.65 of 2018 on the file of Additional District & Sessions Court, Sivagangai, seeks interim bail.

2.This Accused No.14 has seeking interim bail, on the ground that her father by name Muthiah, aged about 75 years, died on 04.01.2022, at Kachanatham Village, Manamadurai Taluk, Sivagangai District. On behalf of the Accused No.14, her mother moved this petition.

3.The learned Government Advocate (Crl.Side) has also confirmed the fact that the father of the Accused No.14 died yesterday (ie., 04.01.2022) and the body is kept in the place of residence, as mentioned in the petition.

CRL OP(MD) No.322 of 2022 4.Considering the situation, this Court is inclined to grant interim bail to the Accused No.14 for a period of three days, to attend the last rituals of her father.

5.Accordingly this Criminal Original Petition is allowed and the Accused No.14 namely Meenakshi, W/o.Chandra Kumar, Kachanatham Village, Manamadurai Taluk, Sivagangai District is ordered to be released on interim bail on today (ie.,) 05.01.2022 at 05.00PM, on her executing a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand Only) to the satisfaction of the Superintendent of Prison, Madurai.

6.The Superintendent of Prison, Madurai is hereby directed to release the Accused No.14 on executing bond to his satisfaction forthwith. It is made clear that the Accused No.14 shall surrender before the concerned Prison on or before 08.01.2022 at 05.00 PM without fail. Further the petitioner/accused shall be released on interim bail with escort, preferably women escort. 7.The Superintendent of Prison, Madurai is directed to file a compliance report before the regular Court on 11.01.2022. 8.Post the matter before this Court on 11.01.2022. sd/- 05/01/2022 / TRUE COPY / 05/01/2022 Sub-Assistant Registrar (C.S.)
