Respondents PRAYER :- This Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned proceedings of the 3rd respondent in Na/Ka.No. 15/ Forecast.D5PS/2025 dated 30.12.2025 and quash the same as illegal and consequently direct the respondents to grant permission and protection to conduct Kabadi and Cultural programs on 17.01.2026 and 18.01.2026 within the period that may be stipulated by this Court. 1/5

ORDER

This writ petition is filed for Writ of Certiorarified Mandamus challenging the impugned proceedings of the 3rd respondent in Na/Ka.No.15/ Forecast.D5PS/2025 dated 30.12.2025 and quash the same as illegal and consequently direct the respondents to grant permission and protection to conduct Kabadi and Cultural programs on 17.01.2026 and 18.01.2026.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

3. The learned Government Advocate (Crl.Side) on instructions would submit that they would permit the conduct of Kabadi and cultural programmes, provided the petitioner removes the condition restricting participation exclusively to members of their community. . 2/5

However, the learned counsel for the petitioner would submit that for the past four years, Kabadi and cultural programmes have been conducted among members of their own community for the welfare of the youth belonging to that community. He would submit that there is no legal bar or impediment to conducting such programmes exclusively for members of their community.

5. Therefore, this Court is of the view that therespondents cannot prevent the petitioner from conducting programmes among members of their own community. However, if persons belonging to other communities express their desire to participate in the programme, the petitioner may permit such participation and shall not prevent them from taking part.

6. Hence, the impugned order is set aside. The respondents shall permit the petitioner to conduct the programme, subject to such other necessary conditions as may be imposed.
