ORDER : The Court Made the following order :- The petitioners are arrayed as Accused Nos.1 to 3 in Crime No.152 of 2015 on the file of the respondent police, for the offences punishable under Sections 147, 148, 294(b), 324, 307 and 506(ii) of the Indian Penal Code. The petitioners were arrested and remanded to judicial custody on 16.07.2015. They have come forward with this petition seeking bail.
2. The case of the prosecution is that on 15.07.2015 at about 07.00 p.m., the petitioners abused the defacto complainant and others in filthy language and gave life threat to him.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case.
4. The learned Government Advocate (Criminal Side) submitted that there are two previous cases pending against the petitioners and tension is still prevailing. The police picketing is also posted in the area and the injured person had already been discharged from the hospital.
5. Considering the submission of the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) and also considering the fact that the injured person had already been https://hcservices.ecourts.gov.in/hcservices/
discharged from the hospital, this court is inclined to grant bail to the petitioners.
6. Accordingly, the petitioners are directed to be released on bail, on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Srivaikundam and on further condition that the petitioners shall stay at Melur and report before the Melur Police Station daily at 10.00 a.m. until further orders.
