ORDER : The Court Made the following order :- The petitioner/sole accused who was arrested by the respondent police on 17.05.2015 for the alleged offences punishable under Section 332 IPC r/w Section 3 of TNPPDL Act in Crime No.72 of 2015 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that when the conductor of the bus asked the accused to buy ticket he refused and he was sent down from the bus and enraged over the same the accused pelted stone on the bus thereby caused damage to the backside glass of the bus and assaulted the conductor, who is the defacto complainant in this case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and prays for grant of bail to the petitioner.
4.The learned Government Advocate(Crl.side) appearing for the State submitted that the accused damaged the backside glass of the bus worth about Rs.6500/-.
5.The learned counsel for the petitioner undertakes to deposit Rs.5,000/- to the credit of Crime No.72 of 2015. 6.Considering the facts and circumstances of the case, I am inclined to grant bail to the petitioner, with certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Aruppukottai, and on further condition that the petitioner shall deposit Rs.5,000/-(Rupees five thousand only) to the credit of Crime No.72 of 2015 and the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. sd/- 12/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
