PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent to grant 40 days ordinary leave to the petitioner's son without escort who is confined in Central Prison, Madurai by name Balamurugan, S/o.Santhanam(C.P.No.6069) a life convict for the purpose of attending serious illness of his mother by considering the petitioner's representation dated 26.12.2024.

Being aggrieved with inaction of the prison authority without taking any decision on the application for ordinary leave, the present Writ of Mandamus is filed.
2.After notice, the matter is listed today for consideration. 3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
4.The learned Additional Public Prosecutor appearing for the respondents states that the representation on behalf of the life convict dated 20.02.2025 seeking 40 days ordinary leave was considered and rejected vide proceedings dated 21.02.2025 in No.233/cj2/2024 by the Deputy Inspector General of Prison(Range), Madurai.
5.In the light of the fact that the petitioner's representation had already been considered and disposed of, nothing survives for adjudication in the writ petition seeking Mandamus. Hence, the Writ Petition is dismissed with liberty to the petitioner to challenge the rejection order, if so advised. No costs.
