ORDER : The Court made the following order :- The petitioner / Accused No.3, who was arrested and remanded to judicial custody on 13.11.2024 for the alleged offence under Sections 8(c), 20(b)(ii)(c) and 29(1) of NDPS Act, 1985, in Crime No.244 of 2024, on the file of the respondent police, seeks bail.

2. The learned Additional Public Prosecutor submitted that the investigation is still pending.

3. Heard the learned counsel on either side and perused the material records of the case.

4. After hearing the learned counsel on either side and perusing the records, it is alleged by the prosecution that the accused persons were caught red handed and were found in possession of 21 kgs of ganja. For the present, what is available before this Court is only the FIR and the counter that has been filed by the respondent. With these materials, it will not be possible for this Court to enlarge the petitioner on bail without satisfying the requirements under Section 37 of the NDPS Act. 2/3

5. In view of the above, the petitioner can await for the completion of the investigation and the filing of the police report and thereafter, revive his claim for bail.
