ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for an alleged offence punishable under Sections 377 and 506(ii) of IPC in Crime No.317 of 2014 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the accused have tortured the son of the de facto complainant, who is mentally retarded person for immoral act.

3.The learned counsel for the petitioner submitted that the first accused was granted anticipatory bail by the Court of Session, Trichy and his condition was also relaxed. He further submitted that the petitioner is also ready to surrender before the Court of Session and the application can be considered on merits.

4.The learned Government Advocate (Crl.side) submitted that the first accused granted anticipatory bail by the Sessions Court and the earlier two applications of this petitioner were dismissed by this Court.

5. In such circumstances, I am not inclined to grant anticipatory bail to the petitioner. However, considering the submission of the learned counsel for the petitioner, the Sessions Court shall consider his bail application on merits on the same day of his surrender. Accordingly, the petition is dismissed.
