ORDER : The Court Made the following order :- The petitioner/A1 who was arrested by the respondent police on 15.04.2015 for the alleged offences punishable under Sections 302 and 201 IPC in Crime No.91 of 2015 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that in the year 1974, the wife of the first accused was murdered by the deceased and due to the motive, the accused have attacked the deceased on 13.04.2015 and caused his death.
3. The learned counsel appearing for the petitioner submitted that the petitioner is a senior citizen aged about 70 years and he could not even walk without the help of others and even as per the prosecution, the earlier occurrence had taken place in the year 1974 and the deceased was released after serving sentence long ago. It is further submitted that the petitioner has been incarceration for more than 60 days and major part of investigation is over.
4.The learned Government Advocate(Crl.side) appearing for the State submitted that this is the case of retaliation and the petitioner had attacked with arival. It is further submitted that the second accused who is the son of the first accused was also secured and he is in judicial custody.
5. Considering the facts and circumstances of the case. I am inclined to grant bail to the petitioner, with certain conditions. https://hcservices.ecourts.gov.in/hcservices/
6. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Usilampatti, and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders.
