O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to subdivide the properties comprised in Ayan Punjai S.F.No.258/5, measuring an extent of 7,200 sq.ft., bearing Plot Nos.18, 19 and 27 and Ayan Punjai S.F.No.259/7, measuring an extent of 3,850 sq.ft., bearing Plot No.28, situated at Valavandhankottai Village, Thiruverambur Taluk, Tiruchirappalli District and to issue patta in favour of the petitioner within such time frame as may be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The case of the petitioner is that the properties were purchased by the petitioner's mother. After her demise and the petitioner's father, the petitioner and his brother, S.Udayasankar, are the only surviving legal heirs. Due to misunderstanding between the petitioner and his brother, the petitioner filed a suit in O.S.No.476 of 2023 on the file of the I Additional District Court, Tiruchirappalli, for partition. Subsequently, a compromise was arrived at between the petitioner and his brother and the petitioner's Page No. 2 of 5

brother, on receipt of the market value of his share, relinquished all his rights in the properties in favour of the petitioner.

4. Though the petitioner had applied for subdivision and issuance of patta as early as on 20.11.2023, the respondent has not taken any action thereon. Therefore, the petitioner has been constrained to file the present Writ Petition.

5. The learned Additional Government Pleader appearing for the respondent would submit that the petitioner's representation dated 20.11.2023 would be considered and appropriate orders would be passed by the respondent within a period of eights weeks.

6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondent to consider the petitioner's representation dated 20.11.2023 or any representation submitted by the petitioner after the compromise decree in O.S. No.476 of 2023, if any, on its merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. The said Page No. 3 of 5

representation shall be considered and disposed of after conducting an enquiry. The respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by the decision.
