PRAYER:- FOR ANTICIPATORY BAIL IN CRIME NO.124 OF 2023 ON THE FILE OF THE RESPONDENT POLICE.
ORDER : The Court Made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 8(c), 20(b)(ii)(B) & 25 of the NDPS Act, in Crime No.124 of 2023, seeks anticipatory bail. 2.The case of the prosecution is that on 25.03.2023, at about 01.30 p.m, on secret information, the respondent police went to the spot and found 4 persons with two 1/3
bags in two motor bikes bearing Reg.No.TN-58-PW-4107 and TN-65-AH-4416. On seeing the police party, 3 persons fled away from the scene of occurrence and 1 person was secured by the respondent police. Hence, a Law Enforcing Authority registered a case against the accused persons.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the State submitted that since the non-appearance of the petitioner during the course of investigation, the respondent police filed Absconding Charge Sheet before the concerned Criminal Court.
5.
