ORDER : The Court Made the following order :- The petitioner / A8, who was arrested and remanded to judicial custody on 19.02.2023 on execution of Non-Bailable Warrant issued by the Principal Special 1/3
Court for EC & NDPS Act Cases, Madurai, for the offences punishable under Sections 8(c) r/w 20(b)(ii)(c), 29(1) of NDPS Act and 328 of IPC in C.C.No.376 of 2022, seeks bail.
2. The case of the petitioner is that the petitioner along with other accused found in possession of 100 Kg of Ganja. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that this is the second bail petition. Earlier petition filed by the petitioner in Crl.OP (MD)No.10593 of 2023 was dismissed by this Court on 20.06.2023. The petitioner is in judicial custody from 19.02.2023. Hence, he prays for grant of bail to the petitioner. 4.Heard the learned Additional Public Prosecutor appearing for the State would submit that this is the second bail petition. Earlier petition filed by the petitioner was dismissed by this Court on 20.06.2023. He would further submit that there is no change of circumstances. Hence, he vehemently, opposed to grant bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering the fact that there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
