ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 305(a) and 137(2) of BNS, 2023, in Crime No.446 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant lives with his family and his brother-in-law, Karumuthu T.Sundaram, runs Hari Automobiles at Sri Ram Complex, Madurai, with three assistans namely, Jeevanantham, Ajith and Bala. On 06.04.2025, Sundaram did not attend calls and his house was found locked. CCTV footage showed him leaving by car with three unknown persons at 08.00 a.m. The assistants informed the defacto complainant, who lodged a complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. side) appearing for the 2/5

respondent Police submits that it is case of jumped bail and that a non-bailable warrant was issued against the petitioner.

5. Considering the facts and circumstances of the case, this Court is directing the petitioner to surrender before the concerned Judicial Magistrate and file a recall application. On such application, the concerned Judicial Magistrate shall consider the same in accordance with law on merits on the same day.

6. With the above said directions, this Criminal Original Petition is disposed of.
