ORDER : The Court Made the following order :- The petitioner/sole accused who was remanded to judicial custody pursuant to his surrender on 15.05.2015 for the alleged offences punishable under Sections 468 and 471 IPC in Crime No.292 of 2015 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the accused had produced a bogus Police Clearance Certificate to obtain a job in a Shipping Company.
3. The learned counsel appearing for the petitioner submitted that the petitioner is a ITI graduate and he had to join duty on 20.11.2014 and when he was in Mumbai, his relatives had obtained Certificate and he was not aware of the offence alleged to have been committed in the office of the Superintendent of Police. He further submitted that the petitioner moved an application for anticipatory bail in Crl.O.P.No.1831 of 2015 and it is held that custodial interrogation for the petitioner is very much necessary and he voluntarily surrendered on 15.05.2015 and investigation is over.
4.The learned Government Advocate(Crl.side) appearing for the State submitted that the petitioner had forged signature of the Superintendent of Police, Tuticorin District and created a bogus Police Clearance Certificate and the petitioner has no bad antecedents.
5. Considering the facts and circumstances of the case. I am inclined to grant bail to the petitioner, with certain conditions. https://hcservices.ecourts.gov.in/hcservices/
6. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with
two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruchendur, and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders.
