PRAYER :- For Bail in Crime No.1344/2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 21.12.2020 for the offences punishable under Sections 379, 430 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act 1957, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner was illicitly transporting 1⁄4 unit of river sand in the bullock cart. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has nothing to do with the alleged offence.

4.The learned Additional Public Prosecutor would submit that the petitioner is having one previous case for similar offence and hence, he vehemently opposed to grant bail to the petitioner. 5.Taking note of the facts and circumstances of the case and also the fact that one previous case is pending against the petitioner for similar offence, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this criminal original petition stands dismissed.
