COMMON PRAYER : FOR BAIL IN CRIME NO.359 OF 2021 ON THE FILE OF THE RESPONDENT POLICE.
COMMON ORDER : The Court Made the following order :- The petitioners/A1 to A5, who are facing a trial for the offence punishable under Sections 8(c) r/w 20(b)(ii)(c) and 25 of NDPS Act in C.C.No.50 of 2022 on the file of the Principal District and Sessions Court for EC and NDPS Act Cases, Madurai in Crime No.359 of 2021 on the file of the respondent police, seek bail. 2.The learned Additional Public Prosecutor would submit that this is the second application for bail and in this crime number, 240kgs of Ganja was recovered from the accused and this Court while https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD) No.996 of 2023 dismissing the earlier bail applications in Crl.O.P.(MD)Nos.8834, 8839, 8883, 8884 and 8889 of 2022, dated 04.07.2022, had directed the learned Trial Judge to complete the trial within a period of five months from the date of receipt of a copy of that order. He would further submit that four witnesses have been examined sofar and it will be possible for the trial Court to complete the trial within a further period of two months. He would further submit that there is no change of circumstances and hence, he would pray for dismissal of these petitions.
3.It is a case where the accused were arrested for having found in illegal possession of 240kgs of Ganja. This Court, on 04.07.2022 had dismissed the applications filed by the petitioners with the direction to the learned trial Judge to complete the trial within a period of five months from the date of receipt of a copy of that order.
4.In view of the above, these Criminal Original Petitions are dismissed with a direction to the learned Principal District and Sessions Court for EC and NDPS Act Cases, Madurai, to strictly comply with the order passed by this Court in Crl.O.P.(MD)Nos.8834, 8839, 8883, 8884 and 8889 of 2022, dated 04.07.2022 and complete the trial as expeditiously as possible, preferably, within a period of two months from today.
