ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 to A4, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 447 and 506(i) of I.P.C. in Crime No.468 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.The case of the prosecution is that the petitioners trespassed into the land of the de-facto complainant and criminally intimidated him.
3.The learned counsel for the petitioners submitted that 12 members gang including the de-facto complainant had grabbed the land of the first petitioner to an extent of 4 acres 34 cents in S.No.126 and 341/1 for which, the first petitioner gave a complaint against them and also filed a petition under Section 482 Cr.P.C., before this Court in Crl.O.P.No.9903 of 2015 to register the case against them. As a counter blast, this complaint is registered against them. https://hcservices.ecourts.gov.in/hcservices/ 4.The learned counsel further submitted that the first petitioner is a practicing Advocate in Dindigul District and the
second petitioner is a Doctor working in ESI Hospital at Chennai and the third and fourth petitioners are the wife and sister-in-law of the first petitioner. He further submitted that the petitioners are an innocent and they have been falsely implicated in this case. 5.Heard the learned Government Advocate (Crl.side) appearing for the respondent.
6.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.
7.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Ottanchathiram and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
8. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
