Respondents/Appellants/Defendants Prayer:- This Second Appeal filed under Section 100 of Civil Procedure Code, against the Judgment and Decree passed by the Principal District Judge, Virudhunagar District at Srivilliputhur in A.S.No.26 of 2011 dated 25/02/2013 reversing the Judgment and Decree passed in O.S.No.139 of 2008 dated 30/03/2011 on the file of Subordinate Judge, Srivilliputhur.

ORDER:- This Second Appeal coming on for orders on this day and upon perusing the earlier order dated 21/04/2021 and upon hearing the arguments of M/s.M.Ashokkumar, Advocate for the Petitioner and of M/s.A.Thirunavukkarasu, Advocate for the Respondents, this Court made the following order:

S.A.(MD)No.556 of 2013 was disposed of in terms of an understanding that appeared to have been arrived at between the parties.

2.The learned counsel on either side in fact informed me that the matter can be deferred till filing of a formal memo of compromise. However, I felt that since the issue had been resolved, the matter can be given quietus. It now turns out that one of the parties is having second thoughts and that has put the counsel to embarrassment. Therefore, the judgment and decree dated 21.04.2021 is suo motu recalled. Registry to list S.A.(MD)No.556 of 2013 for physical hearing on 01.09.2021 at 2.15 pm., The appellant is directed to be present before this Court in person on 01.09.2021 at 2.15 pm.
