PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the M.C.No.183/2022 on the file of the Family Court, Coimbatore and transfer the same to the Sub Court, Uthamapalayam or any other competent court at Theni District. ORDER

The present transfer civil miscellaneous petition has been filed by the father seeking to transfer M.C.No.183/2022 on the file of the Family Court, Coimbatore which was filed by his minor son seeking maintenance to Sub Court, Uthamapalayam.

2. According to the learned counsel appearing for the petitioner/father, he is not able to appear for every hearing before the Family Court, Coimbatore and hence, he wants it to be transferred to Sub Court, Uthamapalayam.

3. Considering the fact that the minor son is an ordinary resident of Coimbatore, this Court is not inclined to transfer M.C.No.183 of 2022 out of Coimbatore. However, considering the request of the petitioner, the Family Court, Coimbatore is directed not to insist upon the personal appearance of the petitioner/father, unless it is compulsorily required.

4. With the above said observations, this Transfer Civil 2/4

Miscellaneous Petition stands closed. No costs. Consequently, connected Civil Miscellaneous Petition is also closed.
