ORDER : The Court Made the following order :- The petitioner, who is the sole accused in Crime No.147 of 2015 on the file of the respondent police, was arrested on 06.04.2015 for the alleged offences punishable under Sections 294(b), 307 and 302 of I.P.C., and hence, seeks bail.
2. The case of the prosecution is that the petitioner had illicit intimacy with the deceased, who was living away from her husband, subsequently, she did not want to have contact with the accused and her family members also warned him on 03.04.2015. Due to the said animosity, the petitioner is said to have attacked the deceased with a knife on 04.04.2015 and caused her death.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that he has been incarceration for more than 75 days and the investigation is over.
4. The learned Government Advocate (Crl.side) opposed the bail petition stating that the petitioner is a single accused and due to previous enmity, the petitioner had attacked the deceased with knife. https://hcservices.ecourts.gov.in/hcservices/ It is further submitted that the major part of the investigation is over.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Natham, Dindigul and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. sd/- 22/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
