Second Appeal is filed under section 100 of Civil Procedure Code, against the judgment and decree dated 21.02.2002 made in AS.No.18 of 2000 on the file of the Subordinate Judge, Sivagangai reversing the well considered judgment and decree dated 12.11.1999 made in O.S.No.62 of 1999 on the file of Additional District Munsif Court, Sivagangai.

ORDER: This Petition coming on for hearing on this day, upon perusing the affidavit and material papers filed, and upon hearing the arguments of Mr. V.K. Saravanan, Advocate for the petitioner, and of Mr.C.Ramesh, Government Advocate on behalf of the 10th Respondent, this Court made the following order: https://hcservices.ecourts.gov.in/hcservices/

Read this in conjunction with and in continuation of the earlier proceedings of this Court dated 03.04.2018. 2.I deem it appropriate to extract the earlier proceedings dated 03.04.2018 and the same reads as follows: 'Except Mr.C.Ramar, learned Additional Government Pleader, for tenth respondent, there is no representation before this Court.

List the Civil Miscellaneous Petition under the caption 'for dismissal' on 05.04.2018.'

3. The position is not different today. Today also Mr.C.Ramar, learned Additional Government Pleader appearing for the tenth respondent alone is before this Court, though the matter is listed under the caption 'For Dismissal'.

4.Under the aforesaid circumstances, I have no option other than dismissing this petition for default/non prosecution. 5.Accordingly, this civil miscellaneous petition is dismissed for default/ non prosecution.
