ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-8 in Crime No.545 of 2015 on the file of the respondent police was arrested and remanded to the judicial custody by the respondent police on 18.04.2015 for the alleged offence under Sections 147, 148, 341, 342 & 302 of I.P.C and hence seeks bail.
2. The case of the prosecution is that due to election dispute, on 17.04.2015, the accused Nos.1 to 6 have attacked the deceased with lethal weapons and caused his death, while the other accused abetted the commission of offence.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that on the date of occurrence, he was working in a reputed bakery in Madurai and he was not at all present in the scene of occurrence. It is further submitted that even as per the case of the prosecution, the petitioner was watching the movement of the deceased and informed the same to the prime accused in this case.
4. The learned Government Advocate(Crl. Side) vehemently opposed this application by stating that the accused Nos.2, 3, 6, 7 and 13 had absconded and the investigation is at crucial stage. He further submitted that the petitioner has no bad antecedents.
5. However, considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai, and on further condition that the petitioner shall appear before the respondent police daily twice morning at 10.00 a.m and evening at 5.30 p.m., until further orders. sd/- 15/06/2015 / TRUE COPY / https://hcservices.ecourts.gov.in/hcservices/ Sub-Assistant Registrar (C.S.)
