PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 2 and 3 to take appropriate action as against the fourth respondent for the act of caused water pollution, environmental pollution and public nuisance in accordance with the Cattle Trespass Act, 1871 by considering the 1/5

ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) This writ petition has been filed seeking a direction to the second and third respondents to take appropriate action as against the fourth respondent by considering the petitioner's representation dated 11.08.2025 and 19.01.2026 for making water pollution, environmental pollution and public nuisance.
2.The case of the petitioner is that the fourth respondent is rearing sheep and goat and leaving them in the public street without properly maintaining them. It is the further contention of the petitioner that the fourth respondent does not have a proper cattle shed to maintain the sheep and goat. Further, he regularly washing his all goats resulting 2/5
in drainage water flowing into the public street, thereby causing nuisance to the general public. Hence, the petitioner has made a representation before the authorities concerned to take action as against the fourth respondent. Since the same was not considered, the petitioner has filed the present writ petition.
3.The learned Special Government Pleader appearing for the respondents 1 and 2 submitted that the petitioner's representation would be considered and appropriate orders would be passed on merits and in accordance with law within the time stipulated by this Court. 4.In view of the above, this Court, without going into the merits of the claim made by the petitioner, directs the authority concerned to consider the petitioner's representations dated 11.08.2025 and 19.01.2025 and pass appropriate orders on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioner, the private respondent, as well as any other interested parties. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

5.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
