PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to conduct survey and demarcate and prepare the FMB map afresh, in respect of property comprised in Survey No.95/6 an extent of 0.09.00 hectare (22 Cents) of wet land, situated at Pactheri Village, Thiruchuli Revenue Village, Thiruchuli Taluk, Viruthunagar District.

ORDER
This Writ Petition is filed seeking a Writ of Mandamus directing the respondents to conduct survey and demarcate and prepare the FMB map afresh, in respect of property comprised in Survey No.95/6 an extent of 0.09.00 hectare (22 Cents) of wet land, situated at Pactheri Village, Thiruchuli Revenue Village, Thiruchuli Taluk, Viruthunagar District.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property. The petitioner submitted a representation dated 25.07.2025 requesting survey and fixation of the boundaries of the said property and redraw the field Map. Despite the same, the third respondent has failed to take any action, causing undue delay and prejudice to the petitioner. The petitioner, therefore, seeks a direction to the third respondent to conduct the survey and fix the boundaries and prepare the FMB afresh, within a time frame fixed by this Court.
4. The learned Government Advocate appearing for the respondents would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents 3 and 4 to consider the petitioner's representation dated 25.07.2025 and demarcate the subject property, after considering the claims of the petitioner and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the
Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
